General Terms and Conditions and Rules for Electronic Services

§ 1 Seller and scope

  1. The online shop taurus-peptides.com ("Shop") is operated by Armin Wincek, sole trader (jednoosobowa działalność gospodarcza) under the business name ARMIN WINCEK, trading as Taurus Peptides, ul. Warszawska 40/2A, 40-008 Katowice, Poland, entered in the Polish business register CEIDG, NIP (tax ID) 9542909711, REGON 544930367 ("we"). Contact: support@taurus-peptides.com.
  2. These Terms apply to all purchase contracts in the Shop and to the Shop's electronic services (§ 4). They are also the rules within the meaning of Art. 8 of the Polish Act on the Provision of Electronic Services.
  3. The RUO Policy and the Withdrawal Information form part of these Terms.

§ 2 Definitions

  1. Consumer means any natural person who enters into a legal transaction for purposes predominantly outside their trade, business or profession.
  2. Business customer means any natural or legal person or partnership with legal capacity that, when concluding the contract, acts in the exercise of its trade, business or profession.
  3. Sole trader with consumer rights means a natural person who concludes a contract directly connected with their business registered in the Polish CEIDG where the contract is not of a professional nature for them (Art. 7aa of the Polish Consumer Rights Act). The provisions of these Terms on the right of withdrawal, unfair terms and conformity of goods apply to them as to consumers.

§ 3 Intended purpose of the products and access requirements

  1. All products are intended exclusively for research and laboratory purposes (Research Use Only). They are not authorised or intended as medicinal products, food, food supplements, cosmetics or medical devices and are not offered as such. They are not intended for use in humans or animals. Details are set out in the RUO Policy.
  2. Only persons aged 18 or over who purchase the products exclusively for research and laboratory purposes may order. The customer confirms this when accessing the Shop and with every order.
  3. We deliver only to addresses in the European Union.
  4. We may refuse an order if there are concrete indications of use contrary to paragraph 1 or of a breach of paragraph 2. If such indications only arise after the contract has been concluded, we may withdraw from the contract until the goods are handed over to the carrier (RUO Policy, section 5). We then refund amounts paid in full without undue delay and in any event within 14 days; the customer incurs no further costs.

§ 4 Electronic services

  1. We provide the following electronic services free of charge: a) the catalogue and, where published, certificates of analysis and the batch search; b) shopping cart and order form (also without a customer account); c) customer account with sign-in via a link sent by e-mail or, where offered, via a Google account; d) e-mail notification when a sold-out variant is available again ("waitlist"); e) order status page with shipment tracking and withdrawal function.
  2. Technical requirements: an internet-enabled device with a current web browser with cookies enabled, and an e-mail address.
  3. Customers must not submit unlawful content or misuse the services (e.g. automated mass requests, circumventing security measures).
  4. The services under paragraph 1 (a) and (b) end when the customer leaves the page or completes the order. The status page is available for 90 days from the order. The customer may end the customer account and the waitlist at any time free of charge (account deletion in the account, unsubscribe link in every notification, e-mail to support@taurus-peptides.com). We may terminate these services with 14 days' notice, or with immediate effect in the event of serious breaches of these Terms or the RUO Policy.
  5. Customer accounts not used for 24 months and without an open order are anonymised.
  6. Using the internet involves typical risks, e.g. malware and phishing.

§ 5 Order and conclusion of contract

  1. The presentation of products in the Shop is not a binding offer.
  2. The customer places products in the cart, enters contact and delivery details, selects shipping and payment methods, confirms the RUO declaration and acknowledges these Terms and the Withdrawal Information, and submits a binding offer by clicking "Order with obligation to pay". Before submitting, the customer can review and correct all details.
  3. After receiving the order we send an order confirmation by e-mail. With it we accept the offer and the contract is concluded. The order confirmation contains the contract data, these Terms, the Withdrawal Information with the model withdrawal form, the payment instructions and the link to the status page.
  4. We store the contract text. The customer can view the order on the status page or in the customer account.
  5. Maximum quantities per item and order and a minimum order value may apply. The Shop shows them before the order is placed.

§ 6 Prices, taxes, discounts

  1. All prices are final prices in euro (EUR) or Polish złoty (PLN) and include statutory VAT. Shipping costs and any payment method fees (e.g. cash on delivery) are added and shown separately before the order is placed.
  2. VAT is charged in accordance with the law: for deliveries to Poland at the Polish rate, for deliveries to other EU Member States, where required by law, at the rate of the country of delivery (EU OSS scheme). The applicable rate and total price are shown before the order is submitted and are binding.
  3. Where prices are reduced, we also state the lowest price we charged in the 30 days before the reduction.
  4. Quantity tiers, bundles and voucher codes apply on the terms shown in the Shop. Vouchers cannot be redeemed for cash and cannot be combined with other discounts unless stated otherwise for the voucher.
  5. We send invoices electronically by e-mail or make them available on the status page.

§ 7 Payment

  1. The payment methods shown during checkout apply; their availability depends on the country of delivery, currency and shipping method: a) Bank transfer (prepayment) quoting the order number. The amount must reach us within the period stated in the order confirmation (currently 3 business days). We reserve the goods until then. b) Credit or debit card via the payment page of our card payment service provider, whose name is shown there. c) Cryptocurrency via BTCPay Server, operated by us or on our behalf; payment goes directly to our wallet; not available for delivery to Poland. The amount in EUR or PLN is converted when the payment request is created; the payment request is valid for a limited time. Network fees for the payment are borne by the customer. d) Cash on delivery when collecting from an InPost parcel locker (delivery to Poland only, payment in PLN) for the cash-on-delivery fee shown, due on collection.
  2. Underpayments by bank transfer or cryptocurrency of up to EUR 1.00 or PLN 4.00 count as payment in full. In the event of larger differences we contact the customer; overpayments are refunded.
  3. If payment is not received within the period under paragraph 1 (a) or within the validity of the payment request, we may withdraw from the contract within 14 days of expiry of the period; the customer then no longer owes the purchase price. We inform the customer by e-mail and refund partial amounts received without undue delay.
  4. If the customer does not collect a cash-on-delivery parcel, we may withdraw from the contract within 14 days of receiving the returned parcel; the customer then owes neither the purchase price nor the cost of the return. After repeated non-collection of cash-on-delivery parcels or several unpaid orders we may block cash on delivery for the customer; other payment methods remain available.

§ 8 Delivery

  1. We ship from Poland, currently with InPost and DPD. Within Poland we deliver to the door and to InPost parcel lockers, to all other countries only to the door. The countries and shipping methods available are shown at checkout. Every shipment is tracked.
  2. We ship after receipt of payment, for cash on delivery after conclusion of the contract. The expected delivery time is shown on the shipping page and during checkout. If no delivery time is stated, we deliver within 30 days of conclusion of the contract.
  3. Shipping costs depend on the country of delivery and the shipping method; above an order value shown in the Shop, shipping is free.
  4. For delivery to a parcel locker, the goods are handed over when the customer collects them there. The carrier states the collection period.
  5. For consumers, the risk of loss of or damage to the goods passes only upon handover to the consumer or to a person designated by them (other than the carrier). If a shipment is lost, we will, after clarification with the carrier, deliver again or refund the purchase price. For business customers, the risk passes upon handover to the carrier.
  6. If delivery fails for reasons for which the customer is responsible (e.g. wrong address), the customer bears the cost of redelivery.

§ 9 Right of withdrawal

Consumers and sole traders with consumer rights have a statutory right of withdrawal of 14 days. Details are set out in the Withdrawal Information.

§ 10 Conformity of goods and complaints

  1. We are liable in accordance with the law for the conformity of the goods with the contract, in particular with the product description (name, quantity, specification). We do not owe any particular effect or result of any use (§ 3).
  2. Towards consumers and sole traders with consumer rights, the statutory remedies for lack of conformity (repair or replacement, price reduction, termination of the contract) and the statutory time limits apply; these Terms do not restrict them. Towards other business customers, liability for defects (rękojmia) is excluded to the extent permitted by law; obvious defects must be notified within 7 days of receipt.
  3. Please send complaints to support@taurus-peptides.com or in writing to ul. Warszawska 40/2A, 40-008 Katowice, stating the order number, a description and your request. The order number and description help us handle it but are not a requirement for a complaint. We reply within 14 days; if we do not reply in time, a consumer's complaint is deemed accepted.
  4. We do not give any additional guarantee.

§ 11 Batch recalls

If a batch later turns out not to meet its specification, we inform affected customers by e-mail and offer replacement or refund. Statutory rights remain unaffected.

§ 12 Liability

  1. We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under product liability law and in all cases in which liability cannot be limited by law.
  2. Otherwise, we are liable towards consumers in accordance with the statutory provisions.
  3. Towards business customers (except sole traders with consumer rights under § 2(3)), in cases of slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract and at most the value of the order concerned; we are not liable for loss of profit.
  4. Using the products contrary to § 3 and the RUO Policy is prohibited. Statutory liability rules remain unaffected.

§ 13 Complaints about electronic services

Please send complaints about the electronic services (§ 4) to support@taurus-peptides.com. We reply within 14 days in text form.

§ 14 Out-of-court dispute resolution

  1. Consumers can contact a consumer advice body. In Poland these are the consumer ombudsmen (rzecznik konsumentów) and the regional Trade Inspection inspectorates; the one responsible for our registered office is the Śląski Wojewódzki Inspektor Inspekcji Handlowej (ul. Brata Alberta 4, 40-020 Katowice). The register of out-of-court dispute resolution bodies is kept by the Polish Office of Competition and Consumer Protection (UOKiK, www.uokik.gov.pl). For cross-border disputes, the European Consumer Centre in the consumer's country of residence can help.
  2. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body. We handle complaints directly (§ 10(3), § 13).

§ 15 Data protection

How we process personal data is described in the Privacy Policy.

§ 16 Governing law, jurisdiction, contract language

  1. Polish law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Consumers keep the protection of the mandatory provisions of the law of their habitual residence.
  2. Proceedings against consumers may be brought only at their place of residence; consumers may also sue us at our registered office. For business customers (except sole traders with consumer rights under § 2(3)), the court at our registered office has jurisdiction.
  3. The contract language is the language of the order (English, Polish or German). The Polish version is the original; all language versions have the same content. For a contract concluded in English this version is binding.

§ 17 Amendments

  1. A purchase contract is governed by the version of these Terms in force at the time of the order.
  2. We may amend the rules for the customer account and the waitlist for good reason, in particular in the event of changes in the law, new functions or security requirements. We inform registered customers by e-mail at least 14 days in advance. Customers who do not agree may end the service free of charge before the amendment takes effect.

All products exclusively for research and laboratory purposes (Research Use Only). Not for use in humans or animals.
